FAQs about Personal Injury Lawyers & Injury Claims

Is it worth hiring a personal injury attorney?

Absolutely. Unlike an insurance company, a personal injury attorney fights for your best interests. You'd think it would be easy to get compensation. You are clearly injured and the other person was clearly at fault, so you should get help paying your bills. But insurance companies are protecting their policyholders and their bottom line, so they will work very hard to find excuses not to pay you. The situation is particularly complex for those facing criminal charges. With a skilled personal injury lawyer on your side, you can fight for the compensation you deserve, including recovery of medical expenses and lost wages.

What compensation can you receive from a personal injury claim?

Our personal injury lawyer can pursue compensation for physical, emotional, and financial losses stemming from your accident or injury. These include medical bills, trauma, lost wages, and other losses that might not be immediately apparent to the injury victim.

What is a good settlement offer?

Insurance companies typically start by offering a very low settlement. While it is tempting to accept the first settlement offer, you should speak to personal injury attorney David Partovi before accepting any offer from your insurance company. He can evaluate your claim and determine the extent of the damages, determine whether future damages are needed, and establish fault if the insurance company is trying to blame you.

Washington State Personal Injury What You Should Know

Comparative Fault

If you are partially responsible for causing your injuries, you can still recover compensation. However, your settlement or jury award will be reduced by whatever amount you are at fault. For example, if a car accident is 10 percent your fault and your settlement or award is $10,000, you will only receive $9,000.

Bad Faith

In Washington, an insurance company can be penalized for unreasonably denying a claim or acting in "bad faith."  When the law against acting in bad faith was proposed, the insurance industry spent millions of dollars to oppose the legislation. In other words, they exerted extraordinary resources in order to protect their ability to act in bad faith.

Statute of Limitations

In Washington, you have three years from the date of your accident or injury to bring forward a personal injury claim. Failing to do so may result in the dismissal of your case.

No Damage Caps

Some states limit how much compensation you can receive for a personal injury case. In Washington, there is no limit to the amount you can recover.

Idaho State Personal Injury What You Should Know

Comparative Fault

Like Washington, Idaho also follows the comparative fault rule. If you are partially responsible for your personal injury, you won't be disqualified from recovering compensation, but your settlement or jury award will be reduced by the amount you are responsible for.

Bad Faith

Also similar to Washington, Idaho has laws that prohibit unfair claim settlements and prevent insurance companies from acting in "bad faith."

Statute of Limitations

In Idaho, you have two years from the date of your accident or injury to file a personal injury lawsuit. If you do not file a case within two years, you may lose your right to recover any compensation.

Damage Caps

Unlike Washington, Idaho has a damage cap of $250,000 in place for non-economic damages (economic damages like medical bills have no damage cap).
