Like Washington, Idaho also follows the comparative fault rule. If you are partially responsible for your personal injury, you won't be disqualified from recovering compensation, but your settlement or jury award will be reduced by the amount you are responsible for.

Bad Faith

Also similar to Washington, Idaho has laws that prohibit unfair claim settlements and prevent insurance companies from acting in "bad faith."

Statute of Limitations

In Idaho, you have two years from the date of your accident or injury to file a personal injury lawsuit. If you do not file a case within two years, you may lose your right to recover any compensation.

Damage Caps

Unlike Washington, Idaho has a damage cap of $250,000 in place for non-economic damages (economic damages like medical bills have no damage cap).
